Ludo's Quest is published by Martin Drapeau / Activite Messager Inc. ("we", "us"). These Terms of Use cover the Ludo's Quest app for iPhone and iPad (the "App") and the ludosquest.com website, including the web version of the game and its level editor (the "Website"). Together they are the "Service". By using the Service, you agree to these terms. If you do not agree, please do not use the Service.
Our Privacy Policy explains what information the Service collects and how it is used. In short, the App collects no personal data.
The App is free, with no ads, in-app purchases or accounts. It is distributed through Apple's App Store, and your use of it is also governed by Apple's Licensed Application End User License Agreement. Apple is not responsible for the App or its content, and has no obligation to provide support for it. If these terms conflict with Apple's agreement on the App, Apple's agreement applies.
Your progress and settings are stored on your device, and synced through your own iCloud account if you use iCloud. They can be lost if you delete the App or reset your device, and we cannot recover them.
On the Website you can play the game in your browser and build your own levels with the level editor. Levels you build are saved in your browser's local storage and may be lost if you clear or change browsers.
You can choose to publish a level. Published levels, and the name you enter with them, are stored on our server and shown publicly for anyone to play. When you publish, a token is saved in your browser so that you can later change or delete your levels. If that token is lost (for example if you clear your browser data or switch browsers), you will no longer be able to change or delete those levels yourself; contact us and we will help. The token cannot be transferred.

You are responsible for the levels you publish ("User Content"). You keep ownership of your User Content. By publishing it, you give us a free, worldwide, non-exclusive, perpetual license to host, display, copy and share it as part of the Service, for example to show your level to other players or feature it on the Website.
We do not review all User Content before it appears, but we may remove any User Content, or block access to the Service, at our discretion, including content that breaks these rules. If you see something that should not be there, please tell us at info@ludosquest.com.
Ludo's Quest is made for players of all ages. The App collects nothing from children. On the Website, publishing a level makes it public, so children should publish only with a parent's or guardian's permission.
The game, its art, music, characters and the Service are owned by us and our licensors and are protected by copyright and other laws. You may make videos and screenshots of the game; please see the press kit. Other names mentioned on the Service may be trademarks of their owners. We reserve all rights not expressly granted to you.
The Service may link to other websites and services we do not control. We are not responsible for their content or practices, and their own terms and policies apply.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT SAVED PROGRESS OR LEVELS WILL NEVER BE LOST. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.
TO THE EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY USER CONTENT. BECAUSE THE SERVICE IS FREE, OUR TOTAL LIABILITY TO YOU IS LIMITED TO CAD $10. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. This does not take away any rights you have under the consumer protection laws of the place where you live.
We may update these terms. The new version will be posted on this page with a new date. If you keep using the Service after a change, you accept the updated terms.
If any part of these terms is found invalid, the rest still applies. If we do not enforce a part of these terms, we have not waived it. These terms and the Privacy Policy are the whole agreement between you and us about the Service.
